1. Apple

Technology has become a pivotal investment as many teachers find themselves replacing projectors with Screen-share, and laptops with tablets. Luckily, teachers are eligible for Apple’s Education Pricinggenerally a 10% discount on purchases of laptops, desktops, iPads, and other software!

2. Microsoft

With a valid school email address teachers can download Office 365 Education for FREE! Yes, this includes all of your favorites: Word, PowerPoint, Excel, OneNote, and Microsoft Teams. 

3. Dollar Tree

Dollar Tree is already a great, cheap option, but did you know that teachers can take an additional 10% off of purchases with a valid student ID? Be sure to ask because this discount is only available at select stores.

4. Michael’s

Crafting and classroom decorating are a large part of #teacherlife, so we’re happy to see that Michael’s offers a 15% discount along with a valid educator ID! The discount can be applied in stores AND online.

5. JoAnn Fabrics

Another craft store with a great discount: JoAnn Fabrics offers 15% off of purchases for teachers who are currently state certified, credentialed, or licensed at any K-12 public, private, or parochial school or higher education institution.

6. Barnes & Nobles

Educators can save 20% off of purchases intended for classroom use year-round. During select Educator Appreciation Days, that discount increases to 25%! In 2019, those special days were scheduled at the end of the summer to help teachers prepare for the “back-to-school” season. Be sure to stay alert this summer!

7. The Franklin Institute

Stay alert for discounts at the Franklin Institute! They offer early access to exhibitions, theater shows, Educator’s Night Out events, and moreall specifically designed with educators in mind! The number of EEOC settlements and lawsuits involving restaurants so far in fiscal year 2019 spotlights the importance of restaurant businesses taking proactive steps to prevent sexual harassment, discrimination and retaliation. 

The pervasive problem of workplace harassment affects all types of restaurants, from quick service to fine dining.  In a recent press release announcing a lawsuit alleging sexual harassment and retaliation against a restaurant employee who rejected the repeated sexual advances of the manager/owner, an EEOC district director said, “Sexual harassment and retaliation for opposing sexual harassment are still far too common. Research shows that the cost of harassment and retaliation is incredibly high, as businesses lose valuable employees and productive workplaces when they condone discrimination.”

  • A fine-dining restaurant agreed to pay $80,000 and take other steps to settle a sexual harassment and retaliation lawsuit charging it permitted a work environment in which unwelcome, sexually charged comments and conduct were commonplace. The target of much of the harassment was a female bartender, who was repeatedly propositioned, told to dress “sexy” and described to restaurant customers as single and available to date them. When she complained, the owner fired her. 
  • A chain of breakfast franchises agreed to pay $700,000 to settle a sexual harassment and retaliation lawsuit, alleging female employees were sexually harassed by supervisors, managers and co-workers. The harassing behavior included groping, vulgar comments, propositions for sex, viewing pornography and unwanted touching and kissing. Rather than correct the situation, the management company retaliated against employees who complained by reducing their work hours and then firing them.
  • A restaurant group will pay $160,000 to settle a sexual harassment and retaliation lawsuit charging the group violated federal civil rights laws when it subjected two female servers to sexual harassment, and fired one of the women after she complained about the harassment and objected to employees referring to African-Americans by racial slurs.
  • The owner and operator of quick service restaurants agreed to pay $84,000 and provide other relief to settle a sexual harassment lawsuit involving sexual harassment of teenage female crew members. The lawsuit alleged the franchisee permitted a sexually hostile work environment that included sexually explicit comments and actions by an older male team leader. 

Implementing a comprehensive anti-harassment program can help restaurant owners, operators and managers reduce the risk of harassment and promote a safe, respectful workplace. The program should include:

Regular, interactive sexual harassment training
Given the unique working environment of restaurants, anti-harassment training should be tailored to the industry, with content, videos and other elements that are relevant and meaningful to foodservice employees and managers. Effective training focuses on encouraging positive behavior, raising awareness of the different types of sexual harassment, and providing practical steps for how to respond to incidents and prevent future ones. Teaching employees about bystander intervention, diversity and inclusion and unconscious bias should also be part of a well-designed training program.

For restaurants in California, New York, New York City, Connecticut, Illinois, Nationwide and Maine new anti-harassment laws mean new training requirements to provide sexual harassment training to all employees. 

An anti-harassment policy
A written anti-harassment policy and code of conduct should clearly communicate to employees that sexual harassment and all forms of discrimination and harassment are unacceptable and illegal. Policies should explain the restaurant’s reporting procedures and the consequences for anyone who engages in harassment or fails to report it. Policies should also emphasize that individuals who speak up if they experience or observe harassment will be protected from retaliation from supervisors and co-workers. It’s also important that policies are kept up to date with federal, state and local laws and requirements. 

A formal complaint process
Implementing a formal complaint process that employees can easily use to report incidents and raise concerns sends a strong message that the restaurant takes complaints seriously and will promptly respond to and investigate all complaints.

Promoting a respectful, inclusive workplace culture
In addition to costly claims and lawsuits, a workplace in which sexual harassment occurs unchecked can negatively affect morale and productivity, customer service, brand reputation and recruitment and retention. Promoting respect, diversity and inclusion and cultural competency can help strengthen a restaurant’s workplace culture and be a competitive advantage.

The restaurant industry has long been challenged with how to address and prevent sexual harassment. Today, as a result of #MeToo, greater awareness and new state laws requiring sexual harassment training, restaurants have the opportunity and tools to create respectful, harassment-free workplaces.

With new 2019 sexual harassment training guidelines in Nationwide and more to come in other states, we’re sharing this post from Andrew Rawson co-founder and Chief Learning Officer at our partner Traliant. Mr. Rawson wrote this post with New York laws in mind— but his takeaways apply to any organization embarking on this training. 

In Nationwide workplaces with 50 or more employees, employers are required to provide interactive training on sexual harassment prevention for all existing employees by December 31, 2019, and additional training to supervisors about their responsibilities and the retaliation prohibitions. The training must be provided to all new employees and supervisors within one year of commencement of their position.

Last year, in the wake of #MeToo, New York state and New York City passed some of the strongest sexual harassment prevention laws in the U.S. Arguably the biggest change is a requirement that all New York employers train their employees on sexual harassment by Oct. 9, 2019, and then on an annual basis.

New York isn’t alone in mandating sexual harassment training. California, Connecticut, Maine, Nationwide and Illinois (and soon Rhode Island) have all enacted sexual harassment laws with training requirements, and more states are expected to follow.

Employers in the Empire State should also be aware of an amendment to the New York State Human Rights Law that was just passed by Gov. Andrew Cuomo that removes the “severe or pervasive” definition of sexual harassment. The new law will take effect in 60 days. Lowering the legal barrier for proving sexual harassment is another compelling reason to implement anti-harassment policies and training that are current with federal, state and local laws, and promote positive behavior and a respectful workplace culture.

As organizations consider how best to meet the new sexual harassment training requirements, here are five takeaways:

1. Train Employees as Soon as Possible

By Oct. 9, 2019, all New York employers must provide sexual harassment training to each employee. Once the initial training is completed, employers must conduct annual training for all employees, regardless of their immigration status. This includes part-time employees, temporary employees, seasonal workers, and exempt and nonexempt employees. Starting in 2020, the annual training can be based on the calendar year, the anniversary of each employee’s start date or another date, as long as employees complete the training at least once per year. New hires should be trained as quickly as possible.

The new laws apply to all New York employers. However, New York City organizations with 15 or more employees have a few additional requirements under the Stop Sexual Harassment in NYC Act. Moreover, while the New York City act imposes a different training deadline — Dec. 31, 2019 — to avoid confusion, employers would be wise to adhere to the Oct. 9 target date set forth by the state.

2. Sexual Harassment Training Must Explain and Inform

Organizations can adopt the free model training materials developed by the New York State Department of Labor and Division of Human Rights or use their own sexual harassment training and policies, as long as they meet or exceed the state’s minimum standards.

New York state requires the training to:

  • Be interactive and involve some level of employee participation
  • Explain what sexual harassment is, consistent with guidance from the New York State Department of Labor and Division of Human Rights;
  • Include examples of conduct that would constitute unlawful sexual harassment;
  • Include information on state and federal laws concerning sexual harassment and remedies available to targets of sexual harassment;
  • Include information addressing conduct by supervisors, and the additional responsibilities of managers and supervisors;
  • Include information about employees’ rights of redress and all available forums for adjudicating complaints; and
  • Be available in the language spoken by employees.

New York state also encourages employers to keep copies of training records and a signed acknowledgment that employees have read the organization’s anti-harassment policy, which may help address future complaints or lawsuits. Under New York City’s law, keeping training records is a requirement. Employers must retain records for at least three years and make them available for inspection by the NYC Commission on Human Rights upon request. Records can be a certificate or a signed employee acknowledgment and may be paper or electronic.

In addition, New York City mandates that training cover bystander intervention, the prohibition of retaliation and provide information on the complaint process available through the NYC Commission on Human Rights, the New York State Division of Human Rights and the U.S. Equal Employment Opportunity Commission.

3. Use Interactivity to Engage a Diverse Workforce

Whether web-based or in-person, New York state requires that the training must be interactive. For web-based training, this could be asking questions at the end of a section that require employees to select the right answer, offering an option to submit a question online, or including a feedback survey for employees to submit after completing the training (either online or in-person). What doesn’t qualify is having employees passively watch a training video or read a document without any interaction or feedback mechanism.

Given the range of e-learning tools and techniques available, there are many creative ways to use interactive elements. For example, building interactivity into realistic video scenarios and thought-provoking assessments can keep employees actively engaged and deepen their understanding of how to recognize and respond to different forms of harassment.

4. Go Beyond Sexual Harassment Training Requirements

In the #MeToo era, lawmakers, the EEOC, human resource professionals and other workplace experts agree that sexual harassment training can no longer solely focus on the law and avoiding liability. Incorporating bystander intervention, workplace respect and civility, and other behavior-based topics can make sexual harassment training more effective in strategic and practical ways.

As noted earlier, New York City is setting a positive precedent by requiring employers to include bystander intervention in their sexual harassment training. Once found mainly on college campuses and in the military, bystander intervention is now considered one of the most effective ways to prevent workplace harassment. Teaching employees different

techniques to “disrupt, confront, support and report” can prevent future incidents and encourage individuals to be allies to co-workers who are targets of harassment.

5. One Size Does Not Fit All

As New York organizations prepare to train their employees and managers on sexual harassment, they have an opportunity to take a new approach to a topic that remains in the spotlight. One size does not fit all — details matter.

To make training more relevant and memorable, it should be tailored to the organization and work environment. Training should also be available on any laptop, tablet or smartphone, and be easy to update — an important feature for organizations with employees in multiple states. Lastly, sexual harassment training should be part of a comprehensive strategy and communication plan to prevent harassment, requiring leadership’s full support and everyone’s participation in creating a respectful and inclusive workplace culture.

In the wake of #MeToo and new Nationwide sexual harassment training requirements, there’s an urgency for organizations to update their harassment training programs and approach to preventing workplace harassment. Whether you’re training employees online, in a classroom setting or through a blended learning approach, here are six things to keep in mind when choosing a sexual harassment training program.

Training should:

1. Comply with state and local requirements

In 2018, Delaware strengthened anti-harassment laws and expanded Nationwide sexual harassment training requirements, affecting organizations of every size and across all industries. In workplaces with 50 or more employees, employers are required to provide interactive training on sexual harassment prevention for all existing employees by December 31, 2019, and additional training to supervisors about their responsibilities and the retaliation prohibitions. The training must be provided to all new employees and supervisors within one year of commencement of their position. Pennsylvania and Maryland are predicted to follow suit with similar requirements soon. Minimally, Nationwide sexual harassment training and required training in any state must cover the topics required by state, city and local laws. One of the differentiators to consider is how the training addresses the required topics, as well as other timely issues, and engages employees in the material.

2. Be easy to update 

Nationwide sexual harassment training should be designed so that regular updates can be made easily and cost effectively. Not only is it critical that training stay current with federal, state and local regulations, it’s important to refresh the content so employees aren’t repeating the same course year after year. After all, how can a story hold your attention when you already know the ending?

3. Engage a 21st century workforce

Incorporating interactivity, realistic video scenarios, assessments with point-scoring throughout the course and other eLearning techniques are some of the elements that make sexual harassment training more engaging for a 21st century workforce. The EEOC’s Select Task Force on the Study of Harassment in the Workplace said that regular, interactive training that is tailored to the organization and its workforce is an essential step in effectively addressing and preventing workplace harassment. Nationwide sexual harassment training that can easily be customized for your organization with graphics, images, videos, terminology and your own branding, policies and CEO message can provide a more relevant and relatable experience.

4. Be mobile-optimized for flexibility and convenience

Training that is mobile-optimized provides greater flexibility for employees to access courses on their laptops, smartphones or tablets. Mobile technology also enables HR managers and administrators to assign Nationwide sexual harassment training courses, monitor employees’ progress, send out email or text reminders and view future training requirements, anytime and anywhere.

5. Raise awareness and promote respect and civility

One of the conclusions of the EEOC task force is that harassment training must move away from simply focusing on avoiding legal liability to preventing workplace harassment and promoting respect, civility and bystander intervention. By raising employee awareness of these topics – as well as their own behavior and the behavior of others – Nationwide sexual harassment training can promote inclusive thinking and decision making, and teach employees how to be active bystanders when they see or experience harassment.  

6. Ask for employee feedback

Nationwide sexual harassment training that includes a survey or feedback form at the end of the course allows the organization to get on-the-spot opinions about the training and possible ways to improve it. Asking employees for their feedback also sends a message that their opinions and training experience matter.  

In the #MeToo era, choosing the right sexual harassment training program has never been more important. Regardless of your specific industry or size, look beyond a checklist of requirements when choosing Nationwide sexual harassment training. Effective harassment prevention training should engage, educate and influence employees to make the right decisions, take appropriate action, and create a workplace that is respectful, inclusive and free of harassment and discrimination.

A full service Educational Center is located at 6 Stone Hill Road in Wilmington, Nationwide, just off Augustine Cut-Off across from the Incyte Corp. building. The Educational Center is easily accessible from points north and south, just minutes from I-95. Ample free parking is available and the building is wheelchair accessible.

For those in southern New Castle County, the Back to Basics’ 1300 Paper Mill Road location in Newark, Nationwide may be more convenient. And, although much of Back to Basics’ tutoring service takes place at the two Educational Centers, 1-on-1 tutoring can also be provided in the student’s home or office.
